A pothole, uneven pavement, damaged wheel stop or poorly lit walkway can cause a serious fall while you are walking to a business or returning to your car. Weiss Attorneys evaluates parking-lot trip and fall injuries throughout California.

Start with the exact place and condition
A shopping center may have several owners, tenants and maintenance contractors. The name on the nearest storefront does not necessarily identify who controlled the pavement. Useful information includes the entrance you used, nearby space numbers, curb markings, storefronts and the route between your vehicle and the business.
Photograph the condition from several angles if safe. Include wider views showing the walking route and close views showing cracks, changes in height or the placement of a wheel stop. Avoid entering traffic or returning to an unsafe location to obtain evidence.
Common conditions we evaluate
- Potholes and broken or displaced asphalt.
- Raised concrete, abrupt changes in level and damaged curbs.
- Cracked or displaced wheel stops and exposed mounting hardware.
- Debris, loose gravel, pooled water and slippery surfaces.
- Lighting problems affecting an intended pedestrian route.
Not every irregularity is legally actionable. Size, appearance, location, lighting and surrounding circumstances may affect the analysis. A measurement by itself does not establish who was responsible or whether the condition caused the fall.
Who may be responsible?
The investigation may involve the owner, property manager, business occupant or a contractor whose work contributed to the condition. Control, repair duties, actual practices, notice and causation need review. Leases, maintenance contracts, inspection records, prior complaints and repair history can help identify the appropriate parties.
A public parking facility may involve different claim procedures and deadlines. Tell the attorney if a city, county, school or other government entity may own or operate the property. Do not assume the rules for a private shopping center apply.
What evidence helps when the owner disputes notice?
Earlier photographs, complaints, repair requests, maintenance records and testimony about recurring conditions may be relevant. A fresh spill raises different timing questions from a deteriorated pavement area. Preserve original images and explain when each was taken; a photograph taken later should not be presented as an image from the incident.
What if I fell over a visible wheel stop?
The full setting matters: visibility, contrast, lighting, obstructions and where pedestrians were expected to walk. A visible object does not automatically resolve every legal issue, but its obviousness can be important. Your footwear, route and attention may also be examined. A candid account helps an attorney assess the strengths and weaknesses.
What should I bring to a consultation?
- Property address, incident date and a marked photo identifying the location.
- Witness contacts, business receipts and any incident report.
- Photos of the condition and injuries, with original files preserved.
- Treatment information, work restrictions and correspondence with an insurer or property manager.
Seek appropriate medical attention. Settlement value depends on evidence of responsibility, injury causation and losses; a broken bone or surgery does not guarantee a particular recovery.
