How we help after a fall

We investigate what caused the fall, who controlled the area, whether reasonable inspections or repairs could have prevented it, and how the injury affects your life. A fall alone does not establish a valid claim. A useful case evaluation connects a specific unsafe condition, negligent conduct and documented harm.

Weiss Attorneys was established in 1974. We handle accepted personal injury matters under a written contingency fee agreement explaining attorney fees, case costs and responsibility for expenses. Representation begins after we accept the matter and enter an agreement.

What must you prove in a California premises liability claim?

Generally, the claim requires proof that a defendant owned, leased, occupied or controlled property, acted negligently in its use or maintenance, and that this negligence was a substantial factor in causing injury. Several businesses or contractors may have different responsibilities for the same area.

Did the responsible party know about the hazard?

Important questions include whether someone created the condition, actually knew about it, or should have discovered it through reasonable care. Inspection records, employee observations, earlier complaints and the condition’s appearance may help explain how long it existed. There is no single number of minutes that proves every spill case.

A warning cone, a visible condition or an argument that a person should have watched where they were going does not resolve every case automatically. Visibility, lighting, distractions, necessary walking routes and the reasonableness of everyone’s conduct require review. California’s comparative fault rules may reduce recovery when an injured person shares responsibility.

The California Courts civil jury instructions provide the framework for premises liability and unsafe-condition issues.

Preserve evidence before it disappears

EvidenceWhy it matters
Photographs of the exact hazard and surrounding areaShows the walking route, lighting, warnings and condition before cleanup or repair.
Video and witness informationMay show the fall, earlier inspections, how the hazard appeared and who passed through the area.
Incident report and receiptHelps identify the location, time, employees and business involved.
Inspection, cleaning and repair recordsMay help establish notice and maintenance practices; an attorney can evaluate how to obtain them.
Medical records and work-loss documentationConnects the incident to injuries, treatment needs and financial losses.

Report the incident accurately, ask for a report number or copy, and keep the shoes and clothing you wore. Do not alter physical evidence. Tell an attorney promptly about cameras: recordings can be overwritten, and a preservation request should identify the relevant location and time. An incident report is useful even when the business will not immediately provide a copy.

How much is a slip and fall settlement worth?

There is no dependable average that predicts an individual California fall settlement. The value depends on proof of responsibility, medical causation, injury severity and duration, future care, income loss, effects on daily life, comparative fault and available coverage or assets. A fracture or surgery does not create a guaranteed payout.

Before comparing offers, distinguish the gross settlement from the amount remaining after attorney fees, case costs and applicable medical liens or reimbursement claims. A release may close the injury claim even if symptoms continue. Our California personal injury settlement guide explains the broader process.

What should you do after a slip or trip and fall?

  1. Get appropriate medical attention and describe the incident and symptoms accurately.
  2. If safe, photograph the hazard, surrounding area and any warnings before conditions change.
  3. Report the incident and record the names of employees and witnesses.
  4. Keep receipts, original photographs, treatment records, correspondence and work restrictions.
  5. Seek advice before signing a release or assuming that negotiations preserve your filing deadline.

Frequently asked questions

When should I contact a slip and fall attorney?

A consultation can help when the cause of your fall is disputed, the business will not provide records, several companies may control the area, or an insurer has offered a release. Describe the exact condition involved: a spill, raised edge, loose mat, step, or obstruction. That detail helps focus the review.

For your free consultation, bring:

  • The incident date, time, exact address and location within the property.
  • Original photographs, witness contacts, receipts and report details you already have.
  • Treatment information, work restrictions and correspondence about your injury.
  • Any written offer, proposed release or response from the business or insurer.

You can request a review even if some records are missing. Ask what needs investigation, who will handle your matter, and how attorney fees and case expenses will work. Request a free slip or trip-and-fall consultation by phone or video from our Sherman Oaks office.

Can I have a case without a witness?

Possibly. Photographs, video, maintenance records, employee statements and physical evidence may help establish what happened. A missing witness makes a careful review of the remaining evidence especially important.

What if the store will not give me its report or video?

Keep the report number, names of the people you notified, any receipt, and your own dated account. Record whether the business said a video does not exist, was overwritten, or simply will not be released; those are different statements. Preserve the correspondence and tell an attorney about camera locations and timing promptly. Missing footage does not by itself establish what happened or who was responsible. Our store-surveillance preservation guide explains the information to gather.

What if the store says it did not know about the spill?

Actual knowledge is not the only issue. The investigation may examine who created the condition, whether reasonable inspections would have revealed it and whether the business had enough time to respond. The result depends on the evidence.

Can I bring a claim for a sidewalk fall?

Potentially, but identifying the responsible public entity or private party and the applicable legal standard is essential. Public-property cases have distinct requirements and defenses. Do not assume the adjacent property owner is automatically responsible.

How long do I have to bring a claim?

Many California personal injury lawsuits have a two-year deadline, subject to exceptions. Government-related injuries may require an administrative claim within six months, with additional deadlines afterward. Consult promptly rather than waiting for treatment or negotiations to end. See the California Courts personal injury guide.

How much does a fall lawyer cost?

We offer a free consultation. For accepted matters, the written fee agreement explains the contingency percentage, case expenses and how costs are handled. Ask about the expected net recovery as well as the gross settlement.
