Establish the path from the travel lane
A worker’s location on the shoulder and the vehicle’s approach should be documented separately. Available camera footage, marks and vehicle data may help explain whether the driver drifted, made a maneuver or reacted to another event. The vehicle’s final direction on the shoulder is a clue, not a complete account of how it arrived there.
Preserve work-site records
Crew assignments, equipment locations and available traffic-control records can help identify where work was occurring. Such records should be requested for the relevant segment and time. Their existence does not establish that a work-site condition caused the collision. If a separate contractor or public entity is proposed as a defendant, its role and the causal connection need supporting evidence.
