Describe the condition, not just the fact that you fell
A fall review begins with what happened and the condition you encountered. Identify the exact Sacramento property and the part of the premises involved: an entrance, aisle, stair, parking area or walkway. Explain what you personally observed before and after the incident. A fall alone does not establish who is responsible; the circumstances and supporting evidence need review.
Was there liquid, a loose mat, a change in elevation or another condition? Record its location and appearance without guessing its source or how long it had been there. If you did not see the condition until afterward, explain that distinction.
Preserve photographs and identify possible video
Keep original photographs showing both the condition and the surrounding area. Wider views can identify the route, lighting, signs and nearby cameras. Retain the files with their original dates and any messages sent at the time. Tell an attorney promptly about possible recordings; do not assume the property will keep them indefinitely.
- Identify where you entered, the route you followed and where the fall occurred.
- Record the names or roles of employees who responded and when you reported the incident.
- Retain a report number or copy, if one was provided.
- Keep witness contact details and distinguish eyewitnesses from people who arrived later.
Separate the property operator from other parties
The business name on a sign may not identify every party connected with a property. Bring receipts, correspondence, incident-report details and the names of anyone who contacted you. Explain whether the location was a store, apartment common area, restaurant, hotel or public walkway. Avoid assuming ownership or maintenance responsibility from appearance alone.
Flag possible public-agency involvement early and preserve any claim notice or rejection letter in full. Requirements depend on the property and parties. Our Sacramento County injury lawsuit document guide can help organize procedural records for a consultation.
Document the injury and its effect on your day
Keep treatment records, bills, referrals, work restrictions and evidence of missed income together. Describe any relevant prior condition accurately and explain how symptoms or daily activities changed after the incident. Separate treatment that occurred from care that was recommended or is still being considered. Tell us about an insurer’s offer and any proposed release.
How our slip-and-fall attorneys can help
For accepted matters, the review may involve photographs, witness accounts, property records, inspection or maintenance questions, insurance correspondence and documentation of injuries and losses. The evidence determines which questions need further investigation. Ask who would handle your case, how missing records would be addressed and what the next step would be.
Our California slip-and-fall lawyer guide explains the broader evidence review. Read our personal injury settlement guide for questions about an offer, continuing treatment and deductions from a recovery.
Frequently asked questions
Can I request help if I did not receive an incident report?
Yes. Start with the information you have and explain when and to whom you reported the fall. Identify missing documents rather than assuming they exist or that you cannot ask for a consultation without them.
Does a warning sign decide the claim?
A sign is one fact to review alongside its position, the route, the condition and other evidence. Photograph what you observed and discuss the circumstances without assuming one detail determines the outcome.
