Questions for an individual claim

Roadside exposure can create a second event with its own causation questions. The timeline should identify the initial stop, occupants' positions and the approaching driver's available view. Counsel should evaluate each alleged act without treating the roadside location as an automatic defense to the later impact.

Records to organize

  • The collision report, witness contact information and original scene photographs.
  • Available dashcam or nearby surveillance recordings, with timestamps preserved.
  • Vehicle photographs and inspection records relevant to the reported collision.

Preparing for a consultation

Keep a dated account of the collision and preserve the original files rather than editing the only copy of a recording. Organize treatment records, bills, work absences and insurance correspondence. A news report may identify leads, but the underlying records are needed to evaluate an individual claim. The reported severity of another person’s injuries does not establish the value or outcome of your case.
