For an auto accident, pedestrian injury, bicycle collision, premises injury, or similar negligence claim filed in Los Angeles County Superior Court, start with the statewide civil documents and then check the court’s local additions. This guide distinguishes initiating papers, court notices served on defendants, and documents used only at later stages.
Initial filing checklist
| Document | Purpose and limits |
|---|---|
| Complaint | State the parties, facts, causes of action, and requested relief. PLD-PI-001 with appropriate attachments or a properly drafted custom complaint may be used. |
| Summons — SUM-100 | Submit for the clerk’s issuance. Keep the issued version for service. |
| Civil Case Cover Sheet — CM-010 | Use the current statewide version and correct case classification. |
| Local forms and notices | Check current county rules, local civil forms, filing instructions, and documents issued by the clerk. |
| Fee payment or waiver request | Pay the applicable fee or submit the appropriate fee-waiver application if eligible. |
Los Angeles County local documents to check
Los Angeles identifies Civil Case Cover Sheet Addendum and Statement of Location, LACIV 109, among the documents needed to begin a civil case. This local form supplements CM-010 and addresses the case type and filing location. Use the current assignment instructions rather than an old personal injury hub assumption.
This local note identifies a court-specific resource or form; it is not a representation that every other local document is unnecessary. Check the current civil rules, effective dates, filing notices, and assigned department’s orders for the actual case. Forms for family law, eviction, probate, or criminal proceedings do not become injury-case requirements merely because they appear in the same directory.
Service packet and later documents
- Serve the issued summons and filed complaint using a legally authorized method, with the court notices and ADR information required for the case.
- Have the server complete the proper proof of service, commonly POS-010, and file it.
- Calendar each defendant’s response and any CMC from the actual service record and court notice.
- Prepare CM-110 when a CMC is set; a statement of damages and default packet are separate later tasks.
Preserve medical records, photographs, collision reports, witness information, and wage-loss documents. They help prove the claim but are not routinely filed wholesale with an initial complaint. A minor plaintiff, public-entity claim, related action, or requested emergency relief can add separate requirements.
