Kings County Personal Injury Lawsuit Filing Documents

For an auto accident, pedestrian injury, bicycle collision, premises injury, or similar negligence claim filed in Kings County Superior Court, start with the statewide civil documents and then check the court’s local additions. This guide distinguishes initiating papers, court notices served on defendants, and documents used only at later stages.

Kings County local documents to check

Kings provides local rules, civil information, and forms-and-filings resources. Check the civil classification and the new-case notices before using a packet found under another case type. Later hearing arrangements, including a record of the proceedings, should be planned separately.

This local note identifies a court-specific resource or form; it is not a representation that every other local document is unnecessary. Check the current civil rules, effective dates, filing notices, and assigned department’s orders for the actual case. Forms for family law, eviction, probate, or criminal proceedings do not become injury-case requirements merely because they appear in the same directory.

Service packet and later documents

  • Serve the issued summons and filed complaint using a legally authorized method, with the court notices and ADR information required for the case.
  • Have the server complete the proper proof of service, commonly POS-010, and file it.
  • Calendar each defendant’s response and any CMC from the actual service record and court notice.
  • Prepare CM-110 when a CMC is set; a statement of damages and default packet are separate later tasks.

Preserve medical records, photographs, collision reports, witness information, and wage-loss documents. They help prove the claim but are not routinely filed wholesale with an initial complaint. A minor plaintiff, public-entity claim, related action, or requested emergency relief can add separate requirements.
