A fall in a grocery store can leave you with medical bills, time away from work and questions about what happened before you entered the aisle. Weiss Attorneys evaluates California supermarket injury claims involving spills, produce, leaking equipment, loose mats and other unsafe walking conditions.

What makes a grocery-store fall claim different?
The condition can disappear within minutes. An employee may clean a spill, move a display or replace a mat. A later photograph of a clean aisle may say little about what was present when you fell. The investigation should identify the precise aisle or department and build a timeline from the available evidence.
For example, water near refrigerated cases raises different questions from produce dropped by another shopper. The first may call for equipment maintenance and prior leak records; the second may depend on when the debris appeared and whether reasonable inspections would have discovered it. These are investigative examples, not conclusions about any particular store.
Does the store have to know about the spill?
A fall alone does not establish liability. Important questions include who created the condition, whether the responsible business knew or reasonably should have discovered it, what precautions were reasonable, and whether the condition caused your injuries. Inspection records, employee observations and surveillance can help address those questions. The absence of a warning cone does not automatically establish a claim, and a cone does not answer every question about whether a warning was adequate.
Evidence to preserve promptly
- Photographs of the substance, nearby shelves, floor, lighting and warning signs, taken safely.
- The receipt, loyalty-app purchase history or other record identifying the branch and time.
- Names and contact information for witnesses, including people who saw the condition before the fall.
- Employee statements recalled accurately, the report number and any correspondence.
- Your shoes and clothing, original photo files and treatment and work-loss records.
Tell an attorney about cameras covering the aisle and nearby approaches. A preservation request can identify relevant video, incident records, inspections and maintenance information, but does not guarantee the material still exists or will be produced voluntarily. Keep your own copies of anything provided to the store.
Can I have a case without an incident report or video?
Possibly. A witness, contemporaneous photograph, employee observation, receipt or medical history may help reconstruct events. Missing video can make proof more difficult; it does not automatically defeat the claim or prove that evidence was improperly destroyed. Explain what evidence you know exists and what you personally observed.
How are injuries and losses evaluated?
Relevant records may include emergency care, follow-up treatment, imaging, work restrictions, expenses and changes in daily activities. Give providers an accurate history, including prior symptoms. A case evaluation considers responsibility and medical causation as well as the extent of loss; no settlement amount follows automatically from a diagnosis.
What if the store says I should have seen the hazard?
Visibility, shopping displays, lighting, the walking route and your actions all matter. An allegation that you were distracted is something to investigate, not a substitute for reviewing the evidence. Describe the circumstances candidly during your consultation.
