Common areas require a specific investigation

Broken steps, loose handrails, leaking pipes, damaged flooring, uneven walkways and lighting problems raise different factual questions. A common stairwell controlled by management may require a different analysis from a condition entirely inside a tenant’s unit. Responsibility depends on control, the applicable duties, knowledge of the problem and the circumstances of the injury.

Do not assume that an injury on rental property automatically makes the landlord liable. We examine the condition, how it developed, who could address it, what notice existed and whether it caused the fall.

Repair requests can help establish a timeline

Save maintenance-portal submissions, emails, text messages, letters and responses about the condition. Preserve the complete conversation with dates and attachments. A prior complaint about a different location or an unrelated repair may not establish notice of the hazard involved in your fall.

If the condition changed after the incident, note when you observed the change and retain earlier photographs. Later repairs do not by themselves prove the earlier condition was negligent; the history still needs careful legal review.

Who may need to be investigated?

  • The property owner and any management company controlling the relevant area.
  • A maintenance or cleaning contractor whose work may have contributed to the condition.
  • Other parties whose conduct created the hazard, depending on the facts.

The property manager’s name on an email is a starting point, not a complete ownership investigation. Rental documents, notices, repair records and contracts can help identify the relevant entities and responsibilities.

Preserve evidence without putting yourself at risk

  • Photograph the exact step, floor or walkway and its surrounding approach if safe.
  • Record building and unit identifiers, stairwell location, floor level and lighting conditions.
  • Save previous complaints and names of people who observed the problem.
  • Keep incident communications, original photos and any available witness information.
  • Retain treatment records, expense receipts and documentation of work restrictions.

Tell an attorney promptly about security cameras and any inspection or repair scheduled for the area. You do not need to enter restricted areas, confront staff or attempt to recreate the fall.

Can a guest bring a claim?

Being a guest rather than a tenant does not automatically rule out a claim. The reason for your presence, property control and circumstances of the incident matter. Delivery workers and people injured during work may also have workers’ compensation questions requiring separate advice; do not assume a premises claim resolves those issues.

What if management says nobody complained?

A prior written complaint can be useful, but it is not the only possible evidence. The condition’s duration, inspections, employee observations and other circumstances may matter. Conversely, a complaint alone does not prove that the identified problem caused your injuries.
