For an overview of falls at stores and other properties, read our California slip and fall claim guide. Pair it with the branch and shopping-route details below.
Pinpoint the aisle, counter, and condition
A grocery-store incident should be tied to a precise part of the shopping route. Note whether the fall happened near a produce display, refrigerated case, prepared-food counter, checkout, or entrance. If water, a food item, packaging, or a displaced mat contributed, record what you actually saw. Do not infer that refrigeration leaked simply because a case was nearby. A photograph of the surrounding area can help explain the connection between the condition and the route you took.
Preserve the receipt and note the approximate time of checkout or arrival. Identify employees who received your report and anyone who saw the condition before or after the fall. Cleaning records, inspection records, and available video may help establish the sequence of events, but their existence and availability require investigation. If your incident occurred outside the store, distinguish the entrance from a shared sidewalk or parking lot. The chain name alone does not identify who maintained that area.
Preserve the branch and the timeline
- Keep receipts, order confirmations and the exact branch address.
- Write down the incident time, walking route and precise spot involved.
- Report the incident to a manager and request the report number or a copy if available.
- Save original scene photos, witness contact information and the shoes worn.
- Retain medical records, bills and documentation of work missed.
Describe direct observations separately from assumptions. Photograph the wider route as well as the condition when safe. Do not move merchandise, recreate the fall or delay urgent medical care to collect evidence.
Video and responsibility for the area
Tell an attorney the relevant time window and location so preservation requests can identify potentially useful records. Cameras may not cover the incident area, and video or inspection documents may be unavailable. Formal discovery may be necessary. Keep requests and responses; missing footage alone does not establish fault.
An entrance, shared sidewalk or parking area may be maintained by a property owner or contractor. Identify the exact spot and business operating there on the incident date. A current brand listing does not establish who controlled every surrounding area.

How a California premises claim is evaluated
A fall does not automatically establish liability. California premises liability considers whether a defendant owned, leased, occupied or controlled the property, was negligent in its use or maintenance, and caused harm through that negligence. See CACI 1000 in the Judicial Council’s civil jury instructions. An individual review must connect the incident evidence, the responsible party and the injury.
