Documenting a fall during a retail or repair visit
Identify whether the incident occurred near a merchandise display, the checkout and repair counter, the entrance, or an outdoor customer route. Packaging, a displaced mat, or a spill may matter if the evidence connects it to the fall. Record the condition you observed, including its size, visibility, and location. A photograph of the wider aisle can help explain how shoppers approached the area; a close-up alone may omit important context.
Keep a purchase receipt or repair ticket and any pickup message. These materials can help identify the branch and the time window for video preservation. If you were returning a battery or carrying a device, describe what you were holding and whether staff directed your movement. Do not handle damaged batteries or unidentified substances to gather evidence. The legal review should identify the incident-date operator and any property manager or maintenance contractor responsible for the particular surface.
Preserve the branch and the timeline
- Keep receipts, order confirmations and the exact branch address.
- Write down the incident time, walking route and precise spot involved.
- Report the incident to a manager and request the report number or a copy if available.
- Save original scene photos, witness contact information and the shoes worn.
- Retain medical records, bills and documentation of work missed.
Describe direct observations separately from assumptions. Photograph the wider route as well as the condition when safe. Do not move merchandise, recreate the fall or delay urgent medical care to collect evidence.
Video and responsibility for the area
Tell an attorney the relevant time window and location so preservation requests can identify potentially useful records. Cameras may not cover the incident area, and video or inspection documents may be unavailable. Formal discovery may be necessary. Keep requests and responses; missing footage alone does not establish fault.
An entrance, shared sidewalk or parking area may be maintained by a property owner or contractor. Identify the exact spot and business operating there on the incident date. A current brand listing does not establish who controlled every surrounding area.

How a California premises claim is evaluated
A fall does not automatically establish liability. California premises liability considers whether a defendant owned, leased, occupied or controlled the property, was negligent in its use or maintenance, and caused harm through that negligence. See CACI 1000 in the Judicial Council’s civil jury instructions. An individual review must connect the incident evidence, the responsible party and the injury.
